In those cases that have gone to trial, his success in defending his values and undermining confidence in the oppositions' has been excellent. In a case involving a well-known restaurant he uncovered major errors in the valuation approaches used by the opposing appraiser. The court threw out the other appraisal.

In another case his appraised value was used to establish a bank's bidding price at a foreclosure auction. When the bank was later sued he successfully defended his value and assisted the bank's attorney in establishing that the opposition's appraisal was prepared in violation of established ethical standards.

Based on his authorship of two groundbreaking articles on capitalization rates and internal rates of return, Mr. Francis is particularly well qualified as an expert witness relative to capitalization theory, "cap" rates, internal rates of return (IRR's), discounted cash flows (DCF's) and the income approach to value in general.
